Article 2: Applicability

2.1 These general terms and conditions apply to every offer, agreement, and delivery of products and services by LumiDale.
2.2 Before concluding an agreement, these terms and conditions will be made available to the customer. If this is not possible, LumiDale will indicate where the terms can be viewed and that they can be sent free of charge upon request.
2.3 If any provision of these terms and conditions is null or void, the remaining provisions shall remain in full force and effect.

Article 3: Products and Services

3.1 LumiDale offers custom-made LED and smart mirrors tailored to the customer’s preferences and specifications.
3.2 All products are manufactured according to agreed specifications and meet reasonable standards of quality and usability.
3.3 Minor deviations in dimensions, color, or material are inherent to custom work and cannot be considered defects or grounds for cancellation.
3.4 If a product is temporarily unavailable, the customer will be notified and offered an alternative or an appropriate solution.

Article 4: The Offer

4.1 All offers made by LumiDale are non-binding.
4.2 The offer includes a clear description of the products and services. Images are indicative and may slightly differ from the actual products.
4.3 Apparent errors or mistakes in the offer do not bind LumiDale.

Article 5: Delivery and Shipping

5.1 LumiDale delivers within Europe.
5.2 Delivery costs and times are communicated in advance and may vary per order.
5.3 The risk of loss or damage to the products transfers to the customer upon delivery.
5.4 If delivery is delayed due to force majeure, the customer will be informed as soon as possible.

Article 6: Returns and Cancellations

6.1 Exclusion of Right of Withdrawal: Custom-made products are excluded from the right of withdrawal in accordance with Article 6:230p sub f of the Dutch Civil Code.
6.2 Cancellation: Cancellation of an order after confirmation is not possible without written consent from LumiDale. Any incurred costs will be charged.
6.3 Returns for Defects: Complaints about defects must be reported in writing within 14 days of delivery. LumiDale will, if necessary, repair, replace, or provide an appropriate solution.

Article 7: Warranty

7.1 LumiDale provides a 2-year warranty on all products against manufacturing defects.
7.2 Warranty Limitations: The warranty does not apply in the case of:

  • Improper or incorrect use.

  • Modifications made to the product by the customer or third parties.

  • Normal wear and tear, unforeseen circumstances, or external damage.
    7.3 Warranties do not affect the customer’s statutory rights.

Article 8: Payment

8.1 For custom-made products, a deposit of at least 50% of the total amount is required.
8.2 The remaining balance must be fully paid before the product is delivered.
8.3 In the event of late payment, LumiDale reserves the right to charge statutory interest and additional costs.

Article 9: Privacy and Cookies

9.1 LumiDale processes personal data in accordance with the General Data Protection Regulation (GDPR).
9.2 Cookies are used to enhance the website experience. Please refer to our privacy policy for more information.

Article 10: Liability

10.1 LumiDale is only liable for direct damages demonstrably caused by a failure attributable to LumiDale.
10.2 Liability is limited to the invoice amount of the relevant order.
10.3 LumiDale is not liable for indirect damages, including consequential loss or lost profits.

Article 11: Disputes and Applicable Law

11.1 All agreements are exclusively governed by Dutch law.
11.2 Disputes will preferably be resolved amicably. If this is not possible, disputes will be submitted to the competent court in the district where LumiDale is located.

Article 12: Force Majeure

12.1 LumiDale is not liable for delays or damages caused by force majeure, including but not limited to:

  • Natural disasters, pandemics, strikes, or transportation disruptions.
    12.2 In the event of force majeure, LumiDale reserves the right to suspend or terminate the agreement in whole or in part.
